CONTRACT INFO

 


THIS SALE AGREEMENT is made this           day of            2009

BETWEEN:

SKY HIGH GROUP of Kairaba Avenue, in the Kombo Saint Mary Division of The Gambia (hereinafter referred to as “the vendor”) which expression shall where the context so requires its successors in the title and assigns of the one part.

AND

(NAME OF PURCHASER) of (ADDRESS OF PURCHASER),TEL: ………….. I.D No………………………….Next of Kin……………………., the Gambia (hereinafter referred as “the Purchaser”) which expression shall where the context so requires include his successors in title and assigns of the other part.


The Vendor is desirous of selling portion of the said land to the Purchaser which plot number is (Insert plot number) measuring ---m * ---m and the Purchaser has agreed to purchase the same free from in cumbrances for the sum of D……….,000.00 (………… Thousand Dalasis) on the terms and conditions herein after stated.

NOW IT IS HEREBY AGREED AS FOLLOWS:-

1. The Vendors will sell and the Purchaser will buy all the Vendors’ interest in the said plot of land No ……. For the sum of D………., 000.00 (…………. Thousand Dalasis)

2. The Purchaser shall pay to the Vendors the purchase price of D……….., 000.00 (……Thousand Dalasis) as follows:

        ∙       A down payment of D………. Dalasis) (negotiable from 0% to 20%) being ...% of the purchase price upon the  signing  this agreementand the balance of D.000.00 (…………Dalasis) shall be paid to the vendor shall be paid in ... (.. month) equal monthly payments of D……. (Dalasis) until the full sum of D…….. (Dalasis) shall be paid.
   

3. The vendor undertakes to:
       
a.    ensure the payment of all land rents, rates levied in respect of the plot of land; and

b.    apply for the consent of the Secretary of State for Local Government and Lands to assign the plot of land to the Purchaser.

c.    To pay the Capital Gains Tax to the Commissioner of Income Tax

IT IS NOW FURTHER AGREED BY THE PARTIES as follows:-

1.    In case the Purchaser shall fail to pay any of the said installation the day upon which same   shall become due the Vendor may by twenty- eight days notice writing determine this agreement and shall thereupon become entitled to re-enter upon the property and repossess the same free from any right or interest of whatsoever nature theretofore made by the purchaser.

2.    The Vendor shall be entitled to forfeiture 15% of the payment made upto to the contract termination date.the balance shall be repaid to the purchaser by the Vendor within 90 days after this agreement is determined.
